TK Boudoir Session Terms & Conditions

1. Booking a Session with TK Boudoir

(a) Booking Your Experience. TK Boudoir sessions are booked through tkboudoir.com/book-now. When booking, the Client will select one of the following experiences:

(1) The Editorial Experience includes 4 hours of reserved studio time, professional hair and makeup with on-set touchups, unlimited outfit changes, access to all studio sets, a personalized zoom ordering session, and a Print Credit toward one of TK Boudoir's six collections.

(2) The Luxury Boudoir Experience includes 2.5 hours of reserved studio time, professional hair and makeup, unlimited outfit changes, access to all studio sets, a personalized online ordering session, and a Print Credit toward one of TK Boudoir's six Collections.

(3) The Muse Edit includes 1.25 hours of reserved studio time, professional hair and makeup, 4 outfit changes plus the white silk sheet set, 4 studio sets (couch, chaise, tan wall, and white bed set), a personalized online ordering session, and a Print Credit toward one of TK Boudoir's six Collections.

(4) A Taste of Bravery includes 30 minutes of reserved studio time, 1 outfit plus the white silk sheet set, a personalized online ordering session, and a Print Credit toward one of TK Boudoir's six Collections. Professional hair and makeup is not included but may be added for $150.

(b) What Your Session Does Not Include. Your Session Fee covers the experience listed above. It does not include digital images, printed photographs, albums, wall art, or other finished products unless specifically included as part of a promotional offer. Anything not specifically listed as included with your experience is not included in your Session Fee.

(c) Purchasing Your Photographs. With the exception of A Taste of Bravery, an additional purchase is required, but what you choose to purchase is entirely up to you. You do not need to decide what you want to purchase before your session. Most clients choose one of our six Collections, with investment typically ranging from $999–$3,999 after Print Credit is applied, depending on the amount of Print Credit received. Digital images may also be purchased separately in sets of five, beginning at $599. A Taste of Bravery does not require an additional purchase. Flexible payment options are available, including a three-month in-house payment plan, Affirm, Klarna, Afterpay, and PayPal Credit.

(1) Your Print Credit is applied directly toward the purchase price of one Collection. Print Credit cannot be applied toward digital images purchased separately in sets of five. If you choose to purchase digital images in sets of five instead of a Collection, your Print Credit is forfeited. Print Credits have no cash value and cannot be redeemed for cash or refunded.

(2) Some Collections include a Collection Add-On Credit that may be used toward eligible items from the Collection Add-On Menu. Collection Add-On Credit is separate from your Print Credit and does not reduce the purchase price of your Collection. It becomes available only after the purchase of a qualifying Collection and may only be applied toward eligible Collection Add-Ons. Collection Add-On Credit is not available with digital images purchased separately in sets of five, has no cash value, cannot be exchanged for cash or refunded, and any unused amount is forfeited.

(d) Session Fees. Your Session Fee reserves your selected date and time specifically for you and allows our team to begin preparing for your experience. Session Fees are non-refundable. If you cancel your session, your Session Fee will not be refunded. If you reschedule, your original Session Fee will remain attached to your booking subject to the rescheduling policies below.

(e) Promotional Offers. A promotional code, when required, must be used at the time of booking in order to take advantage of that promotion. Promotional offers apply only to sessions booked during the stated promotional period and cannot be applied retroactively to an existing booking. If you book your session under one promotional offer and a different or more valuable offer becomes available later, your original promotional offer will remain attached to your booking and the new offer will not apply. If more than one promotional offer could otherwise apply to a booking, only the offer associated with your booking may be used.

(f) Rescheduling Policy. We understand that life happens and sometimes plans need to change. Each booking includes one opportunity to reschedule.

(1) If you reschedule with more than 30 days notice before your scheduled session, you may move your appointment one time at no additional charge to a weekday, within 8 weeks of your originally scheduled session date.

(2) If you reschedule with 30 or fewer days notice before your scheduled session, you may move your appointment one time, to a weekday, within 8 weeks of your originally scheduled session date. A $200 rescheduling fee will apply. When you complete your session on the new date, the full $200 will be applied toward your image and product order.

(3) If you need to reschedule a second time, if you reschedule outside of the eligible session dates associated with a promotional offer, or if you need to reschedule to a weekend or more than 8 weeks from your originally scheduled date:

(1) You will need to reserve a new session at the current Session Fee and promotional offer available at that time. Any promotion associated with your original booking will no longer apply. Any Session Fee and rescheduling fees already paid will be applied toward your image and product order when you complete your newly booked session.

(g) Cancellation Policy. We understand that sometimes you may need to cancel rather than reschedule. Here is our cancellation policy:

(1) If you cancel within 30 days of the date you booked, there is no additional cancellation fee as long as your scheduled session is still more than 30 days away. Your Session Fee remains non-refundable.

(2) If more than 30 days have passed since you booked, or your scheduled session is 30 days or less away regardless of when you booked, a flat $200 cancellation fee will apply.

(3) Failure to attend your scheduled session is considered a no-show and will also result in the $200 cancellation fee.

 

2. Preparing for Your Session

(a) Review Your Session Information. We provide detailed information to help you prepare for your experience, including your Client Prep Guide, Client Portal, emails, text messages, and other session-specific instructions. Please take the time to review the information we send you before your session. It is there to answer many of the questions that come up and help you get the most out of your experience.

(b) Choose & Prepare Your Outfits. Please review the What to Wear section of the Client Prep Guide before choosing your outfits. An outfit may look cute in person but not necessarily photograph the way you expect, which is why we provide specific guidance about the styles, fits, fabrics, and details that tend to photograph best. Try everything on before your session to make sure it fits and feels the way you want it to. Please remove tags and, if wrinkles would bother you in your photographs, steam or iron your clothing before bringing it to the studio.

(c) Follow Your Preparation Instructions. Please follow any preparation and arrival instructions provided for your specific experience, including instructions regarding hair and makeup, what to bring, arrival time, and anything else needed for your session.

(d) Ask Us If You're Unsure. Most importantly, if you are unsure about something, please ask us. We would much rather answer a question before your session than have you make an assumption that affects your experience or photographs. If anything in the Client Prep Guide, Client Portal, emails, or other information we provide is unclear, please reach out before your session so we can help.

 

3. Privacy & Model Release

(a) Your Images Are Private by Default. Privacy is extremely important to TK Boudoir. Your photographs and session content will remain private and will not be shared publicly without your explicit permission. You are never required to sign a Model Release, and choosing not to give TK Boudoir permission to share your images will not affect your experience in any way.

(b) Giving Permission to Share Your Images. If you choose to allow TK Boudoir to use photographs or video from your session:

(1) From the photography portion of your session, you must sign a Model Release. This may allow TK Boudoir to use approved content on our website, social media, advertising, portfolio, printed marketing materials, and other promotional platforms as outlined in your Model Release.

(2) From the hair and makeup portion of your session, you may give verbal permission. Giving verbal permission means you understand that content from the hair and makeup portion of your experience may be used publicly by TK Boudoir on our website, social media, advertising, portfolio, printed marketing materials, and other promotional platforms.

(c) Revoking Your Permission. You may revoke your permission for TK Boudoir to use your photographs or videos at any time. Once we receive your request, we will stop using your photographs and videos in future marketing. However, revoking your permission does not guarantee the removal of any photographs or videos that have already been shared or published. Once content has been made public, it may remain accessible indefinitely. It may have been shared, reposted, downloaded, screenshotted, cached, indexed by search engines, included in printed or previously distributed marketing materials, or copied by third parties. TK Boudoir may also no longer have access to or control over every website, social media account, advertising platform, or other location where the content was previously published. By giving permission for your photographs or videos to be shared publicly, you understand and accept that the internet is permanent in nature, and TK Boudoir cannot guarantee the removal of content that has already been made public if you later revoke your permission.

 

4. Hair & Makeup

(a) Hair & Makeup for Your Experience. Professional hair and makeup is included with The Muse Edit, The Luxury Boudoir Experience, and The Editorial Experience. It is not included with A Taste of Bravery, but may be added for $150. If you do not add professional hair and makeup to A Taste of Bravery, please arrive camera-ready with your hair and makeup complete.

(b) Hair & Makeup Appointment Time. Hair and makeup is scheduled separately from your photography session and begins approximately 1 hour and 45 minutes before your scheduled session time. You will receive a separate appointment confirmation with your hair and makeup arrival time. Please plan around this earlier arrival time when booking and preparing for your session.

(c) Arrive Ready for Hair & Makeup. If hair and makeup is included, please arrive with very clean, dry hair and a clean, moisturized face. Wear a button-up or zip-up top that can be easily removed without disturbing your finished hair and makeup and allows your artist to blend your makeup into your chest when needed.

(1) If you arrive more than 20 minutes late or with wet hair that requires significant drying time, we may not have enough time to complete your experience as planned and your session may need to be rescheduled. If a reschedule is necessary, the $200 rescheduling fee will apply. When you complete your session on the new date, the $200 will be applied toward your image and product order.

(d) The TK Boudoir Hair & Makeup Style. Our hair and makeup artists create the polished, camera-ready look you see throughout the TK Boudoir portfolio. This typically includes loose curls or waves, defined eyes with lashes, shaped brows, contour and blush, complexion and body color matching when needed, and a nude to rosy-pink lip. Hair and makeup for photography may look or feel different from what you normally wear in everyday life. Your curls are also intentionally styled knowing that they will loosen, move, and get messy during your boudoir session. You will be lying down, flipping your hair, moving through poses, changing outfits, and generally messing it up, and that's expected. Your hair is not intended to remain perfectly curled and untouched throughout the entire shoot.

(1) If you request a different hair or makeup style than what we typically create, we are happy to accommodate your preferences when possible; however, your finished photographs may look different from the hair and makeup shown in our portfolio.

(e) Speak Up While You're in the Chair. Before leaving the hair and makeup chair, please take a good look at your finished hair and makeup and tell your artist if there is anything you would like changed. This is the time to ask for more, less, darker, lighter, curlier, straighter, or anything else you would prefer. We want you to love how you look, and your artist can make adjustments while you are still in the chair. Once your hair and makeup is complete and your photography session begins, TK Boudoir cannot later make your hair or makeup “more” or “less” through our standard retouching process. Personal preferences that were not communicated to your hair and makeup artist while adjustments could be made are not considered in standard retouching.

(f) Hair & Makeup Changes During Retouching. If you later request changes to your hair or makeup that require altering the original appearance, such as changing the amount, color, or style of makeup or significantly changing the appearance of your hair, the image will need to be sent to an outside professional retoucher. This also includes requests to make hair look less messy, restore curls, smooth or reposition significant amounts of hair, or otherwise make your hair look more like it did when you first left the hair and makeup chair. Hair naturally loosens and becomes messier throughout a boudoir session, and correcting that natural movement is not included in our standard retouching. These requests are $50 per image and may extend the normal production timeline.

 

5. Artistic Style.

(a) TK Boudoir’s Creative Discretion. The Client acknowledges that TK Boudoir requires and retains discretion as to how its services shall be provided (e.g. choice of staff members, hair and makeup, choice of sets, choice of location, styling, poses, expressions, lighting, lens choices, composition, culling, editing, retouching, etc).

(b) TK Boudoir’s Artistic Style. The Client acknowledges that she is familiar with TK Boudoir’s portfolio and is requesting TK Boudoir’s services with knowledge of the TK Boudoir’s style; that TK Boudoir’s work is constantly evolving; that TK Boudoir’s services are of unique and artistic nature; that the images created may be different from images taken by TK Boudoir in the past; and that in creating the images, TK Boudoir shall use its personal artistic judgment to create images consistent with its personal vision of the session, which vision may be different from the Client’s vision of the session.

(c) Personal Taste & Appearance. The Client understands that photography is subjective and that personal preferences regarding appearance, expression, posing, styling, or aesthetic taste are not considered a failure by TK Boudoir to provide the services described in this agreement. The additional purchase requirement for The Editorial Experience, The Luxury Boudoir Experience, and The Muse Edit still applies.

 

6. Your Photography Session

(a) Requests & Inspiration. We love when you have ideas! You are welcome to share specific images, poses, outfits, or other inspiration you would love to create during your session. We will do our best to incorporate your requests when they work with your experience, but specific photographs are never guaranteed. Your selected experience, available sets, outfits, lighting, timing, body positioning, and other circumstances may affect what we are able to create.

(b) Studio Privacy & Other Clients. TK Boudoir operates on a carefully planned schedule, and there may be more than one client in the studio at the same time. For example, one client may be finishing her photography session while another is in hair and makeup and another is preparing for her session. We do have separate hair and makeup and getting-ready areas and make every reasonable effort to protect each client's privacy and minimize interaction between clients. Robes are also provided for additional coverage when moving through shared areas of the studio. However, because portions of the studio are shared, we cannot guarantee that you will not briefly see or encounter another client during your time at the studio.

(c) Your Reserved Photography Time. Each experience includes a specific amount of reserved photography time. Outfit changes, posing, preparation, and other transitions take place within that time, and your scheduled end time will not be extended to accommodate them. Please arrive with your outfits selected and be prepared to change quickly and follow your photographer's direction. While your experience may include a certain number of outfit changes or access to certain sets, the number of outfits, sets, poses, or photographs we are able to complete is not guaranteed and will depend on the pace of your session.

(d) Physical Limitations & Posing. Boudoir posing may involve kneeling, arching, lying on the floor or furniture, standing, bending, stretching, or holding positions that may be physically demanding. Please tell your photographer about any physical limitations that may affect your ability to pose and immediately let us know if a pose causes pain or discomfort. You should never continue a pose that feels unsafe or painful.

(e) Participation & Completion of Your Session. You are always welcome to decline a pose, outfit, set, or other part of your session that you are not comfortable with. However, your experience requires your participation and cooperation with your photographer's direction. If you choose to end your session early, are unable or unwilling to continue, or decline to participate or follow direction to the extent that TK Boudoir is unable to reasonably continue the photography session, your session will be considered completed at that time. You will still attend your ordering session, view the photographs we were able to create, and make any purchase required with your experience. Ending a session early does not entitle you to a refund, rescheduled session, credit, additional photography time, or replacement session.

(f) Health, Illness & Impairment. Please do not come to the studio if you are experiencing symptoms of a potentially contagious illness or are impaired by alcohol, drugs, medication, or another substance in a way that may affect your ability to safely participate in your experience. If you arrive visibly ill or TK Boudoir reasonably believes that your health, illness, or impairment may create a safety concern, expose our team or other clients to illness, or prevent you from reasonably participating in your session, we may require you to leave the studio and reschedule. A $200 rescheduling fee will apply. When you complete your session on the new date, the full $200 will be applied toward your image and product order.

(g) Lost Personal Items. Please double-check the studio before leaving to make sure you have all of your personal belongings. TK Boudoir is not responsible for personal items or valuables that are lost, misplaced, or left behind at the studio. If we find something you left behind, we'll do our best to let you know and arrange for you to pick it up.

 

7. Your Ordering Session

(a) Your Photographs Are Purchased Separately. Your Session Fee does not include digital images, printed photographs, or finished products unless specifically stated as part of your experience or promotional offer. Your purchase will be made during your ordering session according to the TK Boudoir Pricing Guide in effect on the date of your photography session.

(b) The Photographs You See Are Proofs. The photographs shown during your ordering session are proofs that have been culled, color-corrected, and given basic global skin smoothing and adjustments in preparation for your appointment. They have not yet received the custom body and background retouching included with purchased custom retouched images. Full custom retouching is completed after your order is placed on the images included with your purchase.

(c) Your Ordering Session Is Required. Your personalized online ordering session is a required part of your TK Boudoir experience. This is when you'll see your photographs for the first time, select your favorites, choose what you'd like to purchase, and finalize your order. We do not send proofing galleries, previews, or image teasers in place of an ordering session.

(1) If you do not schedule or attend your ordering session, TK Boudoir will make reasonable efforts to contact you and provide an opportunity to complete it. If you do not complete your ordering session within 30 days of your photography session without an alternative arrangement approved by TK Boudoir, your booking will be considered abandoned and treated as a cancellation by you. A $200 cancellation fee will apply, all amounts already paid will remain non-refundable, and TK Boudoir may permanently delete your photographs and other session materials.

(d) Purchasing Decisions & Your Final Order. All image and product selections and purchasing decisions are made during your ordering appointment. At the conclusion of the call, you will carefully review and sign your Order Form confirming your purchase. It is your responsibility to make sure the information on your Order Form is correct before signing it. Your purchase will either be paid in full or an available payment plan will be selected, completed, and signed at the conclusion of your ordering appointment. Once your Order Form is signed, your order is final and cannot be canceled, returned, exchanged, or changed. Payments made toward your order are non-refundable.

(e) Review Pricing & Talk to Decision Makers. Please review the TK Boudoir Pricing Guide before your photography session so you have a clear understanding of our Collections, products, pricing, and payment options before you see your photographs (https://go.tkboudoir.co/current-pricing-guide). If anyone else will have input on your purchase or how much you are comfortable spending, please share the Pricing Guide with them and have those conversations before your ordering appointment so everyone knows what to expect. Anyone who needs to be involved in the final purchasing decision should attend the ordering session with you. Please do not plan to use your ordering appointment to call, text, or consult someone who is not present before making your decision. All decision makers should review the Pricing Guide in advance and be present on the call.

(f) Scheduling Your Ordering Session. Your ordering session should be scheduled within 10 business days of your photography session unless otherwise approved by TK Boudoir. Before leaving the studio, you'll receive information for scheduling your appointment through our online ordering calendar. Ordering appointments are available only on the days and times shown on our ordering calendar, based on our Studio Manager's availability. Evening and weekend ordering appointments are not regularly available and should not be expected. Exceptions may occasionally be made when absolutely necessary and at TK Boudoir's discretion. If you need to reschedule your ordering appointment, please contact us as soon as possible so we can help you find another available time.

 

8. Payment Plans & Failed Payments

(a) Payment Options. Payment in full is due at the conclusion of your ordering session unless you select and complete an available payment option. TK Boudoir offers a three-month in-house payment plan, as well as third-party financing options including Affirm, Klarna, Afterpay, and PayPal Credit. Third-party financing is considered payment in full to TK Boudoir, and your order will move into production according to our standard paid-in-full production timeline. Your agreement and repayment obligations with a third-party financing provider are between you and that provider and are subject to its terms.

(b) In-House Payment Plans. Our standard in-house payment plan allows your order to be paid over three months. Depending on the circumstances and the amount of your purchase, TK Boudoir may agree to a longer payment plan, but payment terms longer than three months are offered solely at TK Boudoir's discretion and are not guaranteed to be available. We are happy to work with you to establish payment dates and amounts that make sense within the payment-plan term available to you.

(1) Before the conclusion of your ordering session, you must provide two valid forms of payment, make your initial payment, and complete and sign TK Boudoir's Payment Plan Authorization Form. By choosing an in-house payment plan, you authorize TK Boudoir to automatically charge your payment method on the dates and in the amounts shown on your Payment Plan Authorization Form. If your primary payment method cannot be processed, TK Boudoir may charge the alternate payment method you provided for the scheduled payment.

(c) Nothing Is Released Until Paid in Full. Until your order has been paid in full, no digital images, albums, prints, wall art, or other photographic materials will be released or delivered to you. Partial payments do not entitle you to receive a proportional number of images or products from your order.

(d) Production During an In-House Payment Plan. Orders on an in-house payment plan will generally enter our production process approximately 30 days before the final scheduled payment is due. This allows us to begin preparing your order while your payment plan is nearing completion. However, no digital images, albums, prints, wall art, or other finished products will be released or delivered until your entire balance, including any applicable fees, has been paid in full. If you need your photographs or products by a particular date, you may need to pay your remaining balance earlier so there is sufficient time for retouching, design, production, and delivery. The rush-order provisions contained elsewhere in these Terms & Conditions will also apply.

(e) Failed Payments & Communication. We understand that cards expire, banks decline transactions, and unexpected things happen. If an automatic payment fails, TK Boudoir will notify you and give you an opportunity to correct the payment or contact us to discuss the situation. You may receive automatic payment notifications as well as email or text communication from our Customer Relations Manager.

(1) We expect you to communicate with us if there is a problem with your payment plan. If something changes and you are unable to make a scheduled payment, please contact us as soon as possible. When appropriate, TK Boudoir may agree to adjust a payment date or make other reasonable arrangements, but any changes to your payment plan must be approved by TK Boudoir.

(f). Payment Plan Default. If a failed payment remains unpaid for 60 consecutive days and you have not made an alternative payment arrangement approved by TK Boudoir, your payment plan will be considered in default and your order will be canceled.

(1) If your order is canceled because of payment-plan default, all payments previously made are non-refundable, your photographs will be permanently deleted, and you will not receive any digital images, albums, prints, products, or other photographic materials from the session. TK Boudoir will not pursue collection of the remaining unpaid balance on the canceled order.

 

9. Retouching, Production, Products & Delivery

(a) Payment Comes First. Your order must be paid in full before any photographic materials, including downloadable digital images, prints, albums, or other products, are released to you. If you pay in full at your ordering session, your order can begin moving through our production process right away. If you choose a payment plan, your order will begin moving through production based on your payment schedule, but nothing will be delivered until your balance is paid in full.

(b) Selecting Your Images. When your order is ready to begin production, you will receive a password-protected online proofing gallery containing the photographs you selected during your ordering session. If your order includes an album or another product requiring you to choose specific images, you will use this gallery to make those selections. You will have one week to submit your image selections. If we do not receive them within that time, TK Boudoir may select the images for you so your order can continue moving through production. Once you submit your image selections, they are final and cannot be changed.

(c) Your Album Design. If your order includes an album, we will create your initial album layout after receiving your image selections. You will receive an online proof where you can review the design and request changes to the layout. You receive one round of album layout revisions, so please include all requested layout changes at that time. This may include changing page order, swapping photographs, moving photographs between pages, or flipping an image when appropriate. You will have one week to review your album layout. If we do not receive revision requests or approval within that time, we will consider the layout approved and move your order forward.

(d) Making Your Retouching Requests. Once your album layout is approved, or once your final images have otherwise been selected if your order does not include an album, you will have the opportunity to submit your retouching requests. This is the time to tell us about any specific retouching requests you have beyond our standard retouching. Some requests may require additional retouching fees, as outlined elsewhere in these Terms & Conditions. You will have one week to submit your retouching requests. If we do not hear from you within that time, TK Boudoir will complete our standard retouching and move your order into the retouching queue.

(e) Retouching Your Images. Once we receive your retouching requests or your one-week review period expires, your images will enter our retouching queue. Retouching may take up to three weeks. As outlined elsewhere in these Terms & Conditions, TK Boudoir retains creative discretion over the editing and retouching of your photographs. We will consider your requests, but all final retouching decisions are made in accordance with TK Boudoir's artistic style and professional judgment. Once retouching is complete, you will receive your final images and, when applicable, your final album design for approval.

(f) Final Approval. Once retouching is complete, you will have one week to review your final retouched images and album design, submit any permitted final retouching requests, and complete your Final Approval Form. If you request additional retouching, your images will re-enter the retouching queue and may require up to an additional three weeks before you receive them again.

(1) We will make reasonable efforts to follow up with you if we have not received your Final Approval Form, but we cannot hold an order in the approval stage indefinitely. If we have not received your approval or heard from you within 30 days of sending your final retouched images and album design, we will consider the order approved as delivered and move forward with production. At that time, any physical products will be ordered as-is using the final images and design previously provided to you and will be shipped to the TK Boudoir studio. Your final digital images will also be delivered as-is through your password-protected online gallery.

(2) Once your physical products have been ordered, no additional changes can be made to the images, design, or products included in that order.

(g) Your Responsiveness Affects Your Timeline. Each step of production requires either your response or the expiration of the applicable one-week review period before your order can move forward. The faster you respond, the faster we can keep your order moving. If you delay your selections, revisions, retouching requests, approvals, or other required decisions, your place in the production queue may change as other client orders continue moving forward. A requested deadline or estimated completion date does not override these production steps.

(h) Full Gallery of Proofs. If your order includes a Full Gallery of Proofs, the full gallery does not receive the same custom retouching as your purchased retouched images. Custom body and background retouching is completed only on the number of retouched images included with your Collection, digital image purchase, portrait selection, or other printed product. The remaining images in your Full Gallery of Proofs are delivered as they appeared at the proof stage.

(i) Digital & Product Delivery. Once your final images and album design, when applicable, are approved and your balance has been paid in full:

(1) Your downloadable photographs will be delivered through a password-protected online gallery.

(2) Physical products will then be ordered from our professional labs. Production and delivery times vary depending on what you purchase. Our Signature Albums are made in the United States, while our Couture and Luxury Albums are handcrafted in Greece and require additional production and international shipping time. Products may be shipped directly to you or to the TK Boudoir studio depending on the product and order arrangements. If your products are delivered to the studio, you may pick them up or pay the applicable shipping fee to have them shipped to you. Please note that packages drop-shipped to you may say TK Boudoir on the box.

(j) Product Longevity. Photography products are made with inks, dyes, papers, fabrics, leathers, metals, and other materials that may naturally change, fade, or discolor over time. TK Boudoir is not responsible for normal changes caused by the inherent qualities or aging of those materials.

(k) Additional Orders & File Storage. TK Boudoir will keep your session files on hand for one year following your session so you may place additional orders during that time. After one year, continued storage of your session files is not guaranteed.

(l) Standard Turnaround Time. Our standard turnaround time is approximately 8 weeks from your photography session to completion of your order. This is an estimate, and your actual timeline may be much shorter or longer depending on when your ordering session is scheduled, whether you pay in full or use a payment plan, what you purchase, and how quickly you complete each step of the selection, design, retouching, and approval process. Digital-only orders are typically completed much faster. Physical product timelines vary depending on the products selected, and albums handcrafted in Greece require additional production and international shipping time.

(m) Rush Orders. If you need your photographs or products by a specific date, please tell us before placing your order. We will always do our best to accommodate your requested timeline when our production schedule allows, and we do not typically charge our own rush fee when we can make it work within our normal workflow. Rush service does not guarantee delivery by a specific date. We will make every reasonable effort to meet your requested deadline, but production times, shipping delays, customs, carrier issues, lab delays, and other circumstances may be outside of our control. TK Boudoir cannot guarantee that digital images or physical products will be received by a particular date, even when rush service has been requested and paid for.

(1) If meeting your requested deadline requires us to move your order ahead of other clients in our production queue, a TK Boudoir rush fee of $50 for each week removed from our standard 8-week turnaround time may apply.

(2) If physical products need to be rushed, you will be responsible for any rush production and/or expedited shipping fees charged by our professional labs, regardless of whether TK Boudoir charges an additional rush fee.

 

10. Shipping, Product Errors & Damage

(a) Shipping or Studio Pickup. Depending on your order and the arrangements made during production, your finished products may be shipped directly to the address you provide or shipped to the TK Boudoir studio for pickup. Packages shipped directly to you may identify TK Boudoir on the packaging. If your order is shipped to the studio, you will be responsible for picking it up during an available pickup time arranged with our team. TK Boudoir does not provide hand delivery or meet clients at alternate locations for product delivery.

(b) Please Review Everything Carefully Before Approval. Before an album or other custom product is ordered, you may be asked to review and approve the design, photographs, text, spelling, product selections, or other details. Please review everything carefully before submitting your Final Approval Form.

(c) Custom Product Errors. Despite everyone's best efforts, mistakes can occasionally happen with custom products. How an error is handled depends on where the error occurred and whether it was present in the information or proof approved by the Client.

(1) If your finished product contains an error that was also present in the proof, order form, or other information you reviewed and approved, the error is considered part of the order you approved and TK Boudoir is not responsible for the cost of replacing it. If you would like the product remade, you will be responsible for the replacement cost charged by our professional lab, which is typically 50% of the original product price. You may keep the original product unless the lab requires it to be returned.

(2) If your finished product contains an error that was not present in the proof or information you approved, TK Boudoir will determine, in its sole discretion, whether the error is major or minor and the appropriate resolution as outlined below. For an error TK Boudoir determines to be major, TK Boudoir will arrange for one replacement product to be made at no cost to you. The incorrect product must be returned to TK Boudoir if requested, and the replacement will be shipped to the studio for pickup. For an error TK Boudoir determines to be minor, you may keep the original product and TK Boudoir may provide $150 as a gesture of goodwill instead of replacing the product.

(d) Confirm Your Shipping Address. If your products are being shipped directly to you, please make sure the shipping address you provide is complete and correct. TK Boudoir is not responsible for packages that are lost, misdelivered, or returned because the Client provided an incorrect or incomplete address. Any costs associated with replacing or reshipping an order due to an incorrect address provided by the Client will be the Client's responsibility.

(e) Packages Lost in Transit. Once a package has been accepted by USPS, UPS, FedEx, or another shipping carrier, delivery is outside of TK Boudoir's direct control. If a package is lost in transit, we will assist with the carrier or lab claim process when possible, but TK Boudoir cannot guarantee replacement or reimbursement for packages lost by a shipping carrier.

(f) Inspect Your Products Immediately. If your order is shipped directly to you, please inspect it as soon as it arrives. Any shipping damage must be reported to TK Boudoir within 5 days of delivery. If the shipping box arrives visibly damaged, please photograph and take a short video of the exterior of the package before opening it. Then document the packaging and product as you unpack it. This documentation may be required by the professional lab or shipping carrier before a replacement can be issued. Claims reported more than 5 days after delivery will be handled on a case-by-case basis. Without timely notice or documentation of the damage, the lab may decline to provide a complimentary replacement. If the lab charges TK Boudoir to remake or replace the product under those circumstances, that cost will be passed on to the Client.

 

11. Changes to the Schedule, Rescheduling & Cancellation by TK Boudoir

(a) Changes to Your Session Schedule. Occasionally, we may need to adjust the timing of your session or hair and makeup appointment due to staffing changes, scheduling needs, or other circumstances at the studio. This may include moving your arrival time, hair and makeup appointment, or photography time earlier or later on the same day. If we need to make a change, we will communicate your updated schedule with you as soon as reasonably possible.

(b) If We Need to Reschedule Your Session. While we make every effort to keep the date we reserved for you, sometimes circumstances outside of our control make that impossible. Illness, injury, pregnancy, severe weather, family emergencies, staffing issues, scheduling conflicts, or other unexpected situations may require TK Boudoir to reschedule your session. In rare circumstances, this may happen with very little notice, including the morning of your scheduled session. If TK Boudoir needs to reschedule your session, we will work with you to find the next available date that works for both you and our studio. Because our calendar may be booked weeks or months in advance, we cannot guarantee how quickly another appointment will be available. This is especially important if you require a weekend session, as weekend availability is extremely limited.

(c) Expenses You Incur Preparing for Your Session. We know you may make other appointments or arrangements in preparation for your session, including hair appointments, nails, waxing, tanning, childcare, travel, lodging, time off work, or other personal services. Unfortunately, TK Boudoir cannot reimburse or be responsible for expenses you incur outside of TK Boudoir if we need to change the timing of or reschedule your session.

(d) Substitute Photographer or Team Member. In rare circumstances, your scheduled photographer, hair and makeup artist, or another member of our team may become unavailable due to illness, injury, family emergency, or another unexpected situation. When appropriate, TK Boudoir may provide a substitute professional rather than reschedule your entire experience. We are extremely selective about the people we trust with our clients and our brand. Any substitute photographer or team member will be someone we believe has the professionalism, experience, and skill necessary to provide the level of service you expect from TK Boudoir. The use of a qualified substitute team member does not automatically entitle the Client to cancel the session or receive a refund.

(e) If TK Boudoir Cancels Your Session. In the rare event TK Boudoir is unable to complete or reschedule your session and we must cancel your booking entirely, we will refund any payments you have made to TK Boudoir, minus the cost of any services that have already been completed or provided.

(1) If TK Boudoir cancels your session because of your conduct or your violation of these Terms & Conditions, the cancellation will be treated as a cancellation by you. You will not receive a refund of any amounts already paid and will be responsible for the $200 cancellation fee.

 

12. No Guests in the Studio, Client Cooperation & Communication, Safe Working Environment

(a) No Guests at the Studio During Your Experience. For the safety of our team, the privacy of our other clients, and the integrity of your experience, guests are not permitted at the studio under any circumstance. Only the Client scheduled for the session may enter the studio. Anyone accompanying you will be asked to leave immediately, and TK Boudoir will not begin or continue your experience until the guest has left the premises.

(b) Client Cooperation & Communication. We ask that you communicate and cooperate with our team throughout the entire TK Boudoir experience, including before and during your photography session, during your ordering appointment, and throughout the retouching, approval, payment, and production process. Many parts of your experience require communication and participation from both you and our team. You agree to respond reasonably, provide information or approvals when requested, and cooperate with the processes outlined in these Terms & Conditions.

(c) Respectful & Safe Working Environment. TK Boudoir is committed to providing a safe, comfortable, and respectful environment for both our clients and our team. You agree to treat TK Boudoir staff with respect and dignity in all in-person, telephone, text, email, social media, and other communications. Harassment, threats, intimidation, yelling, abusive or degrading language, repeated disrespectful behavior, or other conduct that causes a member of our team to reasonably feel unsafe, threatened, harassed, or unable to comfortably continue the working relationship will not be tolerated.

(1) When appropriate, TK Boudoir will notify you of a problem with your behavior and give you an opportunity to correct it. However, TK Boudoir is not required to provide a warning when the conduct is sufficiently serious to justify immediately ending the working relationship. If inappropriate conduct continues after a warning, or if TK Boudoir determines that the conduct is sufficiently harmful, threatening, abusive, or harassing, TK Boudoir may immediately end the working relationship and discontinue any remaining services.

(2) If TK Boudoir ends the working relationship because of your seriously harmful, threatening, abusive, or harassing conduct, you will not be entitled to a refund of amounts already paid, and TK Boudoir may permanently delete any photographs or other session materials that have not already been delivered to you. TK Boudoir will have no obligation to continue photographing, retouching, designing, producing, or otherwise completing any unfinished portion of your experience or order.

 

13. Copyright & Unauthorized Use of Images

(a) Ownership of Images. All photographs, proofs, and other photographic materials created by TK Boudoir remain the property of TK Boudoir and are protected by United States copyright law. Viewing an image during your ordering session does not give you ownership of or permission to copy, save, record, reproduce, or use that image. You receive the right to possess and personally use only the photographs you purchase and that TK Boudoir delivers to you.

(b) No Screenshots or Screen Recording During Your Ordering Session. The photographs shown during your ordering session are unpaid proofs and may not be screenshotted, photographed, screen-recorded, copied, saved, downloaded, reproduced, or otherwise captured in any way. This includes using another phone, camera, computer, screen-recording program, or other device or method to capture photographs displayed during your ordering session.

(c) Unauthorized Copies & Copyright Infringement. If you screenshot, photograph, record, copy, save, or otherwise reproduce an unpaid proof without TK Boudoir's permission, you are creating and retaining an unauthorized copy of TK Boudoir's copyrighted work.

(1) Unauthorized reproduction of copyrighted photographs may constitute copyright infringement under federal law. Under 17 U.S.C. § 504, a copyright owner may be entitled to recover actual damages and profits or, when applicable, statutory damages. Statutory damages may range from $750 to $30,000 per infringed work, and a court may increase an award to as much as $150,000 per work when infringement is found to be willful.

(2) TK Boudoir reserves the right to require payment for any images captured without authorization and to pursue any other remedies available under applicable copyright law. Nothing in these Terms & Conditions gives you permission to possess or use an image simply because you were able to capture or reproduce it during your ordering session.

 

14. Chargebacks & Payment Disputes

(a) Contact Us First. If you believe there is an error with a payment or charge, please contact TK Boudoir before initiating a chargeback or payment dispute so we have an opportunity to review and resolve the issue with you.

(b) A Payment Dispute Does Not Cancel Your Agreement. Initiating a chargeback, payment dispute, or reversal through your bank, credit card company, financing provider, or payment processor does not cancel your booking, order, payment plan, or the payment obligations you agreed to under these Terms & Conditions. If a payment is reversed or withheld as the result of a dispute, any amount that remains legitimately owed under your agreement remains due to TK Boudoir.

(c) Disputes Before Your Session. If you initiate a chargeback or payment dispute before your photography session, TK Boudoir may immediately pause all services associated with your booking until the dispute is resolved and any outstanding balance is paid. If you wish to continue with your scheduled session, you may be required to repay the disputed amount and any fees incurred by TK Boudoir as a result of the dispute before your session takes place. If the matter is not resolved before your scheduled session, TK Boudoir will apply the cancellation by client policies in these Terms & Conditions.

(d) Disputes After Your Session or Order. If you initiate a chargeback or payment dispute after your photography session or ordering appointment, TK Boudoir may immediately pause retouching, album design, product production, digital delivery, physical product delivery, or any other unfinished services until the dispute is resolved and all amounts due are paid. If photographs or products have already been delivered, a chargeback or payment dispute does not give you the right to retain those photographs or products without paying the amount legitimately owed for them. TK Boudoir reserves the right to pursue collection of any unpaid balance and any other remedies available under these Terms & Conditions or applicable law.

(e) Fees & Costs Resulting From a Dispute. If a chargeback or payment dispute results in fees, penalties, collection costs, or other expenses to TK Boudoir and the disputed charge is ultimately determined to have been valid, you will be responsible for reimbursing TK Boudoir for those reasonable costs to the extent permitted by law.

 

15. Limit of Liability

(a) Maximum Liability. To the fullest extent permitted by law, TK Boudoir's total liability to the Client arising out of or related to the Client's session, photographs, products, services, or this agreement will not exceed the total amount actually paid by the Client to TK Boudoir. Under no circumstances will TK Boudoir be responsible for damages exceeding the amount the Client has actually paid to TK Boudoir.

(b) Indirect or Consequential Damages. To the fullest extent permitted by law, TK Boudoir will not be responsible for indirect, incidental, special, consequential, or other damages arising from the Client's session, photographs, products, services, or this agreement, including loss, expense, embarrassment, emotional distress, reputational harm, lost income, lost opportunity, or other consequences beyond the services and products purchased from TK Boudoir.

(c) Photographs or Session Content Shared With Permission. If the Client signs a Model Release authorizing TK Boudoir to publicly use photographs or videos from the photography portion of her experience, or gives verbal permission for photographs or videos from the hair and makeup portion of her experience to be shared as permitted elsewhere in these Terms & Conditions, TK Boudoir will not be responsible for damages or consequences resulting from the authorized publication or use of that content. As explained in the Privacy & Model Release section, once content has been publicly shared, it may be copied, downloaded, screenshotted, reposted, indexed, distributed, or otherwise used by third parties outside of TK Boudoir's control. TK Boudoir is not responsible for the actions of third parties after content has been publicly shared with the Client's permission.

(d) Loss or Failure of Photographic Materials. TK Boudoir takes reasonable care in capturing, processing, storing, and delivering Client photographs. In the unlikely event photographs are lost, corrupted, destroyed, or otherwise unavailable because of equipment malfunction, data loss, file corruption, technical failure, or another circumstance, TK Boudoir's responsibility will be limited to either rescheduling the affected photography session at no additional Session Fee or refunding the amounts paid by the Client for the affected services or products, as determined by TK Boudoir.

(1) TK Boudoir is not responsible for reimbursing any expenses the Client incurred in preparing for or attending the original session or a replacement session, including clothing or lingerie, hair appointments, nails, waxing, tanning, childcare, travel, lodging, time away from work, or other personal expenses or services.

(e) Specific Photographs Are Not Guaranteed. While TK Boudoir will make reasonable efforts to incorporate Client requests and inspiration, failure to capture a particular photograph, pose, expression, outfit, set, or requested image is not a breach of this agreement and does not entitle the Client to a refund, credit, or other compensation. As outlined elsewhere in these Terms & Conditions, TK Boudoir retains creative discretion over the photography and final images created during the session.

 

16. Events Outside Our Control

(a) Events Outside Either Party's Control. Neither TK Boudoir nor the Client will be considered in breach of these Terms & Conditions when a delay or inability to perform is caused by circumstances outside of that party's reasonable control, including severe weather, natural disasters, fire, widespread power or utility outages, government orders, public emergencies, war or civil unrest, labor or transportation disruptions, shipping or customs disruptions, or other extraordinary circumstances that make performance impossible, unsafe, or impracticable.

(b) If Your Session Is Affected. If an event outside of either party's reasonable control prevents your photography session from taking place as scheduled, TK Boudoir will work with you to reschedule your session without a rescheduling fee. Any payments already made will remain attached to your booking, and the session will be moved to the next mutually available date. If you choose to cancel rather than reschedule when TK Boudoir remains willing and able to provide your experience on another available date, the Client cancellation policies contained in these Terms & Conditions will apply.

(c) If Production or Delivery Is Affected. Events outside of TK Boudoir's reasonable control may also delay the retouching, production, shipment, or delivery of your photographs or products. This may include circumstances affecting TK Boudoir, our professional labs, album manufacturers, shipping carriers, customs, suppliers, or other vendors involved in producing or delivering your order. When this occurs, the delay will not be considered a breach of these Terms & Conditions and will not entitle the Client to a refund, cancellation of the order, credit, or other compensation. TK Boudoir will make reasonable efforts to complete and deliver your order as soon as circumstances allow.

(d) Product Availability. In rare circumstances, an event outside of TK Boudoir's control may make a particular product, material, album option, cover, size, finish, or other item temporarily or permanently unavailable. If the exact item you ordered can no longer reasonably be provided, TK Boudoir will work with you to select a reasonably comparable replacement or alternative. If no reasonably comparable replacement can be provided, TK Boudoir's responsibility will be limited to refunding the amount paid for the affected product or portion of the order.

(e) Outside Expenses. TK Boudoir is not responsible for expenses you incur as a result of an event outside of our reasonable control, including clothing or lingerie, hair appointments, nails, waxing, tanning, childcare, travel, lodging, time away from work, or other personal expenses or services.

 

17. Miscellaneous Terms, Construction & Interpretation

(a) Entire Agreement. These Terms & Conditions, together with any documents specifically incorporated into them, contain the entire agreement between you and TK Boudoir regarding your experience and replace any prior agreements or understandings about the same subject.

(b) Waiver. If either party chooses not to enforce a provision of these Terms & Conditions on one occasion, that does not prevent the party from enforcing the same provision, or any other provision, in the future.

(c) Governing Law. This agreement will be governed by the laws of the State of Illinois.

(d) Venue. Any legal action arising from or relating to this agreement must be filed in Union County, Illinois.

(e) Assignment. Neither you nor TK Boudoir may transfer or assign this agreement to another person or business without the other party's written consent.

(f) Severability. If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

(g) Conflicting Terms. If these Terms & Conditions conflict with another agreement between you and TK Boudoir concerning your session or order, these Terms & Conditions will control unless a later written agreement signed by both parties specifically states otherwise.

(h) Construction & Interpretation. These Terms & Conditions are intended to be interpreted according to their fair and reasonable meaning. They will not be interpreted strictly for or against either party solely because one party drafted or prepared them.
